Becoming a West Virginia medical cannabis patient
One telehealth visit, then a state application you'll do online. Here's each step, what to have ready, and the two program rules that surprise most new patients.
Two separate steps, two separate places
West Virginia splits this in half, and knowing that up front saves a lot of confusion:
- The certification — that's us. A West Virginia physician registered with the Office of Medical Cannabis evaluates you and files your patient certification.
- The registration — that's you and the state. You apply through the OMC's online portal, MyComplia, and pay a $50 fee.
Only physicians who've completed the state's mandatory four-hour training course can certify patients, which is why you can't just ask your regular doctor. Our West Virginia providers are registered and trained for exactly this.
The four steps
Most patients are approved within about a month of their appointment.
Book your telehealth visit
Pick a time and fill out the short intake form. You'll speak with a West Virginia physician by phone or video — no office visit, and West Virginia fully permits telehealth certifications.
You'll need to be a West Virginia resident and 18 or older to register on your own. Patients under 18 go through a parent or guardian instead — see the minor patient process.
Your physician files your certification
If you have a qualifying condition, your physician enters your patient certification into the state system. You don't have to carry a paper form anywhere — it's filed electronically for the OMC to see when you apply.
Register and apply on MyComplia
Create your account at the West Virginia Medical Cannabis Portal, then start a new patient application. You'll upload your documents, confirm your certification is showing, and submit. The portal gives you an Application ID at the end — write it down, you may need it for payment.
Then pay the $50 state fee, either online through the portal or by check or money order mailed to the OMC. If you mail it, your Application ID and name have to be in the memo line or the state can't match it to your file. Online is faster and harder to get wrong.

Approval, then download your card
The OMC reviews applications and notifies you by email. West Virginia doesn't mail you a plastic card — once you're approved, you download your digital card straight from MyComplia. Save it to your phone and keep a printed copy in the car.
If something's missing, the state returns the application for correction rather than denying it outright. Fix what they flag and resubmit.
What you'll need for the state application
Gather these before you start and the portal takes about twenty minutes.
- A government photo ID — West Virginia driver's license, state ID, or passport.
- Proof of West Virginia residency — a utility bill dated within the last 60 days, a tax record showing a WV address, a mortgage document, homeowner's insurance for a WV residence, or a voter registration card.
- A passport-style digital photo — plain background, face clearly visible. A phone photo against a blank wall is fine; this becomes the photo on your card.
- Your $50 payment, or your hardship waiver documents if you're requesting the fee be waived.
⚠️ Two rules that surprise new West Virginia patients
Neither one is a problem, but both are better learned now than at the dispensary counter.
- You can't smoke it. West Virginia sells dry leaf flower, but only for vaporization — smoking is not a permitted route of administration. You'll want a vaporizer, and the dispensary can point you to one.
- There are no edibles. West Virginia is one of the last medical states that doesn't allow them. What you can buy: oils, tinctures, gels, pills and capsules, dermal patches, topicals, and dry leaf for vaporizing.
Also worth knowing: home cultivation isn't permitted, and you're limited to a 30-day supply as determined by your certifying physician.

Can I really do this without leaving home?▾
The certification, yes — West Virginia permits telehealth, so your visit with the physician is by phone or video. The state application is done online through MyComplia, and if the computer part is the hard bit for you, call us and we'll walk you through it screen by screen.
When does my card arrive in the mail?▾
It doesn't — West Virginia issues digital cards only. After the OMC approves you, log back in to MyComplia and download your card from your account. Most patients save it to their phone and print a copy for the glovebox. If you're waiting on mail that's never coming, that's usually why.
How long does the state take?▾
The OMC works to a 30-day review. Some patients hear back faster once the certification and payment are both in, but plan around a month. Keep an eye on the email address you registered with — that's where the decision goes, and it's also where a correction request would land.
Do I have to mail a check?▾
No. The portal takes an online payment from a checking account, which is what we'd suggest — it's faster and there's nothing to lose in the mail. If you'd rather send a check or money order, make it payable as the OMC instructs and put your Application ID and your name in the memo line. Payments without an Application ID are the most common reason an application stalls.
Can my regular doctor certify me?▾
Only if they've registered with the Office of Medical Cannabis and completed the state's required four-hour training course. Most primary care doctors haven't, which is why patients come to us. Worth asking yours — but don't be surprised if the answer is no.
What if I can't afford the $50?▾
West Virginia has a financial hardship waiver that drops the fee to nothing for patients at or below 200% of the federal poverty level. If you're on SNAP, Medicaid, SSI, SSDI, or Section 8, your benefit statement is usually all the proof you need. See the full waiver guide.

You need to be a West Virginia resident and be able to document it — that's the point of the residency proof. A utility bill, tax record, mortgage document, or voter registration all work. If your ID still shows an out-of-state address, call us before you apply and we'll talk through what you have.
How much can I buy at once?▾
Up to a 30-day supply, as determined by your certifying physician. You'll need your digital card at the dispensary every time — West Virginia dispensaries can't sell to you without it at the point of sale.
Can I take it across state lines?▾
No. West Virginia's protections stop at the border, and federal law prohibits carrying cannabis between states even where both allow it. Buy from West Virginia licensed dispensaries and keep your medicine in its original labeled packaging.
