About West Virginia's Medical Cannabis Program
West Virginia's medical cannabis program was created by Senate Bill 386, the West Virginia Medical Cannabis Act, signed into law by Governor Jim Justice on April 19, 2017. The program is administered by the Office of Medical Cannabis (OMC) within the Bureau for Public Health, Department of Health and Human Resources. Headquartered at 350 Capitol Street in Charleston, the OMC manages patient registration, caregiver applications, and dispensary licensing.
The first WV dispensary opened in November 2021, and approximately 65 dispensaries are operational across the state today. West Virginia recognizes 15 qualifying serious medical conditions. The Medical Cannabis Advisory Board (MCAB) reviews petitions to add new qualifying conditions and submits recommendations to the Department of Health and Human Resources.
Only physicians who have completed the mandatory four-hour Bureau for Public Health training course are authorized to certify patients. Telehealth certifications are permitted under WV law. Patients are limited to a 30-day supply as determined by their certifying physician, and the program offers a financial hardship waiver of the $50 state application fee for patients with income at or below 200% of the federal poverty level. After OMC approval, patients download their digital medical cannabis card directly from the application portal.

How long is the appointment call?
5-10 minutes. Our WV-registered doctors won't rush you.
What if I miss the doctor's call?
Your doctor will try again and may text. Calls sometimes show as "Unknown" or "Spam Risk." If we can't reach you, our office will follow up to reschedule.
Can I get the $50 state fee waived?
Yes. West Virginia offers a financial hardship waiver that eliminates the $50 OMC application fee for patients with income at or below 200% of the federal poverty level. You'll need to submit proof of income or eligibility for benefits when applying. Our team can help you submit the waiver request along with your portal application.
How do I pay the state fee?
The OMC accepts the $50 state fee either by online payment through the portal or by check or money order mailed to: WV Office of Medical Cannabis, 350 Capitol Street, Room 523, Charleston, WV 25301. If mailing, include your Application ID number and patient name in the memo line. Most patients find the online option faster.
How soon can I visit a West Virginia dispensary?
After you complete the WV OMC portal application and pay the $50 state fee, OMC reviews applications within 30 days. Once approved, you can download your digital medical cannabis card directly from the portal and visit any of West Virginia's approximately 65 operational licensed dispensaries.
Is my card physical or digital?
Digital. West Virginia issues digital medical cannabis cards that you download from the OMC portal once your application is approved. You can show the digital card on your phone or print a copy to bring to dispensaries. No waiting for a card to arrive in the mail.
Do you help if my card isn't working at a dispensary?
Yes. Text or call us. Card problems are almost always state portal issues — and we know how to fix them.
What products can I buy with a WV medical marijuana card?
West Virginia dispensaries sell dry leaf/flower for vaporization, oils, tinctures, gels, pills, capsules, dermal patches, and topicals. Smoking flower is not permitted — flower must be vaporized. Edibles are not currently sold in West Virginia (the state is one of only two medical cannabis states still banning edibles, though House Bill 5260 was introduced in February 2026 and passed the House on second reading in March 2026, which would allow lozenge and gelatin edibles up to 10mg THC per serving). Patients can purchase up to a 30-day supply as determined by your certifying physician.
Is telehealth certification legal in West Virginia?
Yes. West Virginia permits telehealth certifications for medical cannabis. Your doctor must be registered with the Office of Medical Cannabis and have completed the four-hour Bureau for Public Health training course.
How long is my West Virginia medical cannabis card valid?
One year from issuance. Annual renewal required, including the $50 state fee at renewal time (also waivable through the financial hardship program). We recommend renewing 30-60 days before expiration to avoid a gap in dispensary access.

Can I use my West Virginia card in other states?
West Virginia doesn't have formal reciprocity with other states, and West Virginia dispensaries do not accept out-of-state cards.
