What Changed in Ohio: SB 56 (March 2026)
Ohio's cannabis program changed significantly when Senate Bill 56 took effect on March 20, 2026. The bill merged Ohio's medical and adult-use programs under the Division of Cannabis Control (DCC), banned unregulated intoxicating hemp products, and added new rules for both patient groups:
- The 10% adult-use excise tax remains in place for non-medical purchases โ medical patients are exempt.
- New THC potency rules apply (35% minimum for plant material, with extract limits set by the DCC).
- Intoxicating hemp products (Delta-8, Delta-10, THC beverages) are now sold only at licensed Ohio dispensaries โ banned everywhere else, including smoke shops and gas stations.
- Cannabis from non-Ohio retailers (including out-of-state dispensaries) is now recriminalized โ buy only from Ohio-licensed dispensaries.
- SB 56 repealed certain non-discrimination protections previously available to cannabis users. Talk to a qualified attorney about how this may affect your specific situation.
- Strict transportation rules โ cannabis must be in original unopened packaging, or stored in the trunk if seal is broken.
- The DCC is finalizing rules for dispensary-to-door delivery, available to medical patients only.
For frequent consumers, these changes have made the structured, physician-backed medical lane more valuable rather than less. Medical patients still avoid the excise tax, get higher purchase limits, will gain exclusive home delivery access, and maintain a documented patient-physician relationship.

About Ohio's Medical Marijuana Program
Ohio's medical marijuana program was created by House Bill 523 in 2016, codified at Ohio Revised Code Chapter 3796. Originally administered by the State Board of Pharmacy as the Ohio Medical Marijuana Control Program (OMMCP), the program is now administered by the Ohio Division of Cannabis Control (DCC) within the Department of Commerce. Under SB 56, the DCC oversees both the medical program and the adult-use program created by Issue 2. Patient certifications must come from physicians who hold a Certificate to Recommend (CTR) issued by the State Medical Board of Ohio.
The medical program covers 26 qualifying medical conditions, with the State Medical Board reviewing petitions to add new conditions during an annual window from November 1 to December 31. As of March 4, 2025, the state registry fee was reduced from $50 to $0.01 โ patients now pay only their physician evaluation fee. The state has signaled intent to fully eliminate the fee in the future.
Adult-use cannabis became legal in Ohio in December 2023 under Issue 2 (codified at ORC Chapter 3780), with sales beginning August 6, 2024. Senate Bill 56 (effective March 20, 2026) modified both programs significantly. Telehealth certifications are explicitly permitted in Ohio.

How long is my Ohio medical marijuana card valid?
One year from issuance. Annual renewal required, including a new physician recommendation visit. We recommend renewing 30 days before expiration to avoid a lapse in dispensary access.
What products can I buy with an Ohio medical card?
Ohio medical patients can purchase plant material (flower for vaporization), edibles, oils, tinctures, oil patches, and other approved forms. Combustion is prohibited for medical marijuana โ flower must be vaporized, not smoked. Medical patients have higher purchase allowances than recreational consumers (who are capped at 2.5 oz flower per transaction).
Can I get medical cannabis delivered to my home in Ohio?
SB 56 enabled dispensary-to-door delivery for medical patients only (no delivery option for adult-use customers exists in Ohio law). The Division of Cannabis Control is in the rulemaking phase for medical home delivery. Once active, it will be available to medical patients exclusively. We'll update this page as the delivery program launches.
Is telehealth certification legal in Ohio?
Yes. Ohio explicitly permits telemedicine evaluations for medical marijuana certifications. Your physician must hold a Certificate to Recommend (CTR) issued by the State Medical Board of Ohio.
Can I use my Ohio card in other states?
Ohio doesn't have formal reciprocity. Some states may recognize Ohio certifications for visiting medical patients โ check the specific state's rules.
